These Terms of Service (“Terms”) govern your access to and use of upthehill.net (the “Site”), operated by Up the Hill Exclusive (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Please read Section 14 (Dispute Resolution) carefully — it requires individual arbitration and waives class actions.
01Age requirement & eligibility
The Site is intended solely for adults 21 years of age or older. By accessing the Site and confirming your age, you represent and warrant that you are at least 21 years old and that you are accessing the Site from a jurisdiction where cannabis and cannabis content are lawful. Cannabis products are for use only by adults 21+ where legal. Keep cannabis out of the reach of children and pets.
02Informational use only — no sale
The Site is a brand and informational resource. We do not sell cannabis, accept orders, or process payments through the Site, and nothing on the Site is an offer to sell. Any purchase of Up the Hill products must be made in person through licensed California dispensaries in accordance with applicable law. Product availability, names, and descriptions are subject to change.
03Acceptable use
You agree not to:
- Use the Site if you are under 21 or where cannabis is prohibited by law.
- Misrepresent your age or identity.
- Attempt to disrupt, damage, or gain unauthorized access to the Site or its systems.
- Use bots, scrapers, or other automated means to access, copy, or harvest content, except for standard search-engine indexing.
- Reverse engineer or attempt to derive source code from the Site.
- Reproduce, distribute, or create derivative works from Site content without permission.
04Intellectual property
All content on the Site — including the Up the Hill Exclusive name, logos, brand marks, strain names (such as “Revenge of the Zith” and “The Flavor Drop”), text, graphics, imagery, and design — is owned by or licensed to Up the Hill Exclusive and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site for personal, non-commercial purposes. You may not use our trademarks or content without our prior written consent. Third-party marks are the property of their respective owners.
05No medical or health claims
Nothing on the Site is intended as medical advice or a health claim. Statements about our products have not been evaluated by the U.S. Food and Drug Administration. Cannabis products are not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before using cannabis, especially if you are pregnant, nursing, or taking medication.
06No legal advice; your compliance
Nothing on the Site constitutes legal advice. Cannabis laws vary by state and locality and change over time. You are solely responsible for knowing and complying with the laws that apply to you. Accessing the Site does not make any conduct lawful where it is not.
07Assumption of risk
Cannabis is an intoxicating product. Consuming it may impair your ability to drive or operate machinery and may carry health risks. By using the Site and any Up the Hill products, you knowingly and voluntarily assume all risks associated with cannabis use. Do not drive or operate machinery while under the influence.
08Third-party links
The Site may link to third-party websites and social platforms. We are not responsible for the content, products, or practices of those sites. Your use of them is at your own risk and subject to their terms.
09Disclaimer of warranties
The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10Limitation of liability
To the fullest extent permitted by law, Up the Hill Exclusive and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100.00).
11Indemnification
You agree to indemnify, defend, and hold harmless Up the Hill Exclusive and its owners, officers, employees, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
12Copyright / DMCA notices
We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act (DMCA) — including identification of the work, the material at issue, your contact information, and a good-faith statement — to info@upthehill.net with the subject line “DMCA Notice.” We may remove allegedly infringing material and terminate access for repeat infringers.
13Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
14Dispute resolution — arbitration & class-action waiver
Please read this section carefully. Except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court, administered in Los Angeles County, California, under the rules of a recognized arbitration provider. You and Up the Hill Exclusive each waive the right to a jury trial.
Class-action waiver. Disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class-action waiver is found unenforceable, the remainder of this section will not apply to that dispute.
15Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
16Assignment, severability & entire agreement
You may not assign these Terms; we may assign them freely. If any provision is found unenforceable, the remaining provisions will stay in full effect. These Terms, together with our Privacy Policy, Cookie Policy, and Accessibility Statement, constitute the entire agreement between you and Up the Hill Exclusive regarding the Site and supersede any prior agreements.
17Changes & contact
We may revise these Terms at any time by posting an updated version on this page with a new “Last updated” date. Continued use of the Site after changes take effect constitutes acceptance.
